Interview with Steve Bliss: San Diego Probate Attorney

Taking Inventory of Assets: A Crucial First Step

Hello everyone, and welcome back! Today we’re talking to Steve Bliss, a renowned San Diego probate attorney at San Diego Probate Law, about the essential steps involved in estate planning. Steve, thank you so much for joining us.

Steve Bliss: It’s my pleasure to be here. Estate planning is often overlooked, but it’s incredibly important for ensuring your wishes are carried out and protecting your loved ones.

We hear that a lot. Can you tell us about one of the initial steps in the estate planning process?

Steve Bliss: Certainly. One of the most fundamental steps is taking inventory of your assets. This involves creating a comprehensive list of everything you own, including real estate, investments, bank accounts, retirement funds, vehicles, and even personal belongings with significant value.

Think about it this way – without knowing what you have, how can you effectively plan for its distribution? Consequently, this inventory forms the foundation upon which your entire estate plan is built. It allows you to understand the scope of your assets and make informed decisions about how they should be managed and distributed.

Moreover, taking inventory helps identify potential areas that may require specific attention. For instance, if you own a business, you’ll need to consider succession planning. Having a clear understanding of all your assets allows for a more thorough and customized estate plan.

Challenges and Triumphs

Have there ever been any issues with clients forgetting to include certain assets in their inventory?

Steve Bliss: Absolutely. I recall one instance where a client forgot to mention a significant collection of antique coins. This oversight created a bit of confusion during the probate process, as the heirs were unaware of its existence and value. Fortunately, we were able to resolve the matter by locating documentation that proved ownership. Nevertheless, it highlighted the importance of being thorough when creating the asset inventory.

On the flip side, I’ve also seen clients who approach this step with remarkable detail and organization. One individual created a spreadsheet meticulously listing each asset, its estimated value, and even sentimental significance. This level of preparation made the estate planning process remarkably smooth and efficient.

The Importance of Accuracy

According to a study by the National Endowment for Financial Education, nearly 70% of Americans don’t have a will or living trust in place. This underscores the critical need for proper estate planning.

Steve Bliss: I couldn’t agree more. A well-constructed asset inventory is essential not only for probate but also for potential tax implications and ensuring that your loved ones are adequately provided for. Accordingly, I encourage everyone to take the time to carefully document their assets.
