Protecting San Diego’s Seniors: An Interview with Ted Cook

Hi everyone, I’m Sam, and today we have the pleasure of chatting with Ted Cook, an elder protection attorney here in beautiful Point Loma. Ted, thanks for taking the time to speak with us.

What Inspired You to Focus on Elder Protection Law?

Ted: “Well, Sam, it’s a deeply personal calling for me. I witnessed firsthand how vulnerable seniors can be to exploitation and abuse. Seeing those injustices ignited a passion within me to protect this deserving population.”

Let’s Talk About the Process: Can You Walk Us Through One of the Key Steps in Elder Protection?

Ted: “Absolutely! The process is designed to be comprehensive and tailored to each individual’s needs. Today, let’s delve into ‘Protective Actions.’ This step often comes after we’ve thoroughly assessed the case and identified the specific risks facing the senior.

  • “Emergency Legal Remedies: We may need to act swiftly by filing for restraining orders or protective orders against abusers. In some cases, notifying Adult Protective Services (APS) is crucial.”
  • “Financial Protections: Protecting a senior’s financial assets is paramount. This could involve freezing accounts, revoking power of attorney if it’s being misused, or preventing unauthorized transfers of property.
  • “Healthcare and Living Arrangements: If the senior’s living situation is unsafe, we work to facilitate a transfer to a more secure care facility. We also coordinate with medical professionals for evaluations and treatment as needed.”

Have You Ever Encountered Any Challenges With Implementing ‘Protective Actions’?

Ted: “Sure, there are always challenges. One instance involved a client whose adult child was financially exploiting them. The child had gained power of attorney and was systematically draining the senior’s bank accounts. We were able to freeze the accounts and initiate legal proceedings to revoke the power of attorney.

It wasn’t easy; the adult child was resistant and threatened legal action against us. But ultimately, we prevailed, protecting our client’s hard-earned savings.”

>“Ted Cook is a true champion for seniors. He fought tirelessly to protect my mother from financial abuse and ensured she received the care she deserved.” – Mary S., La Jolla.

>“I was at my wit’s end trying to help my grandmother who was being neglected in her assisted living facility. Ted stepped in and navigated the legal complexities with expertise and compassion. He truly made a difference in our lives.” – Sarah J., Point Loma.

Ready To Safeguard Your Loved Ones?

Ted: “If you have concerns about the safety or well-being of an elderly individual, don’t hesitate to reach out. I encourage anyone facing these challenging situations to seek guidance and support. Together, we can protect our seniors and ensure they live with dignity and respect.
