Interview with San Diego Probate Attorney Steve Bliss

A Conversation About Estate Planning

Hello everyone, and welcome back to San Diego Legal News. Today, we have the pleasure of speaking with Steve Bliss, a highly respected probate attorney here in San Diego. Steve, thank you so much for joining us.

Steve Bliss: The Importance of Naming Beneficiaries

Steve, many people find the estate planning process daunting. Can you shed some light on one of the key steps involved?

Absolutely. One crucial step that often gets overlooked is naming your beneficiaries. This involves clearly identifying who will inherit your assets and how they will be distributed upon your passing. It may seem straightforward, but it’s essential to consider all angles.

Consequently, think about who you want to receive specific items or portions of your estate. Consider factors like age, financial need, and relationships. Additionally, outline how the inheritance should be handled if a beneficiary predeceases you.

Ordinarily, individuals name immediate family members as beneficiaries. However, it’s not uncommon for people to choose friends, charities, or even trusts as recipients. The key is to make your wishes explicit and legally binding.

Moreover, remember that beneficiary designations can override what’s stated in your will. Accordingly, it’s crucial to keep these designations up-to-date, especially after significant life events like marriage, divorce, or the birth of a child.

I had a client once who thought she had everything covered with her will. However, she neglected to update her retirement account beneficiaries after her divorce. Consequently, her ex-husband ended up inheriting a substantial sum, which was not her intention at all.

It’s estimated that over 50% of Americans do not have a valid will or estate plan in place. (Source: Caring.com)
