Consequently, family dynamics can sometimes complicate this decision. I’ve seen situations where siblings disagree about who should be the executor, leading to potential conflict. In such cases, it may be helpful to consider a neutral third party, like a professional trust company.
Moreover, remember that an executor or trustee’s role can be complex and time-consuming. They will need to gather assets, pay debts and taxes, and distribute property according to your will or trust. Ordinarily, I advise clients to choose someone who is financially savvy and has good communication skills.

I recall a case where a client named his oldest son as executor without fully discussing it with him. The son later expressed feeling overwhelmed by the responsibility and ultimately asked to be removed from the position. It led to delays and additional legal costs.
This experience highlighted the importance of open communication and ensuring everyone involved is on board. I learned that sometimes suggesting a trusted friend or advisor alongside a family member can provide crucial support and help mitigate potential conflict.
